México, DF.- Este lunes 29 de septiembre se llevará a cabo la premier del documental, Bajo Juárez, cinta que aborda los asesinatos de mujeres en Cuidad Juárez, en la voz de una periodista, una madre que pierde a su hija, y una trabajadora de la maquila recién llegada de Veracruz, cuyo rostro representa a las mujeres trabajadoras de Juárez.
El evento se llevará a cabo a las ocho de la noche en Cinemark Reforma, después de la presentación habrá un brindis en el Bar Alfonso del Centro Histórico donde participarán integrantes de la Organización No Gubernamental (ONG), Nuestras Hijas de Regreso a Casa, quienes participan en el documental, Eugenia León, Regina Orozco, así como las Reinas Chulas, entre otros. Encuentro Internacional de Buenas Prácticas contra Violencia
Urge investigar causas estructurales de violencia contra mujeres

México DF, 26 sep 08 (CIMAC).- En los últimos años, las estadísticas se han centrado en la violencia física contra las mujeres, se han dedicado a documentar mujeres golpeadas, a pesar de que hoy en día urge más investigación sobre manifestaciones, causas directas, causas estructurales, secuelas, percepción y representación de la violencia.
Así lo señaló María de la Paz López, del Fondo de Desarrollo de las Naciones Unidas para la Mujer (UNIFEM), al participar en el "Encuentro Internacional de Buenas Prácticas en contra de la Violencia hacia las Mujeres y las Niñas", que se llevó a cabo en la Ciudad de México del 24 al 26 de septiembre.
El Encuentro fue organizado por el Instituto de las Mujeres del DF (Inmujeres-DF) y las organizaciones civiles Defensoras Populares y Coalición contra el Tráfico de las Mujeres y Niñas en América Latina y el Caribe, informó en comunicado el Inmujeres-DF.
Durante el Encuentro, finalizado hoy en el hotel Casablanca de la Ciudad de México, las y los especialistas intercambiaron puntos de vista sobre las experiencias más exitosas en materia de prevención y atención de la violencia en contra de las mujeres, y sobre los obstáculos y retos en la erradicación de este delito.
Participante en el panel Indicadores y Estadísticas de Violencia contra las Mujeres y Niñas, la especialista de UNIFEM aseguró que la violencia es producto de relaciones asimétricas entre los géneros, atraviesa culturas y generaciones e inhibe el desarrollo de los países. "Es un problema público y cuenta con un alto grado de tolerancia de parte de los países", dijo. La violencia, puntualizó, debe ser erradicada y no disminuida.
BUENAS PRÁCTICAS
Durante el panel titulado "Buenas prácticas en materia de persecución, sanción y legislación en el tema de la violencia contra las mujeres", Martha Lucía Mícher Camarena, directora del Inmujeres-DF, aseguró que la violencia en contra de las mujeres merma su autoestima, las aísla de redes sociales y familiares, y les limita la capacidad para defender sus derechos. Por ello, resaltó la importancia de crear modelos de procuración de justicia centrados en la víctima, que partan de un enfoque de derechos humanos y de género.
En este mismo panel, Guadalupe Morfín Otero, fiscal especial para los Delitos de Violencia contra las Mujeres y Trata de Personas, de la Procuraduría General de la República, colocó como primordial el empoderamiento de las mujeres.
"El agente del Ministerio Público debe considerar que tiene enfrente a una víctima, herida, culpabilizada, desprotegida, dijo la Fiscal. Si las mujeres no son apoyadas en cuanto toman la decisión de denunciar, las y los funcionarios pierden la posibilidad de ser acompañados por ellas, como coadyuvantes de la investigación".
La funcionaria señaló que una buena práctica en contra de la violencia hacia las mujeres debe contener, de acuerdo al enfoque de los derechos humanos, cuatro características esenciales: partir de un enfoque innovador, tener impacto en las políticas de género, contribuir a un cambio social a favor de la igualdad y la posibilidad de multiplicarse.

Reunión de alto nivel sobre los ODM
Atroz y vergonzosa, la falta de avance contra Muerte Materna

Nueva York, 26 sep 08 (CIMAC).- Al participar en la Reunión de Alto Nivel sobre los Objetivos de Desarrollo del Milenio (ODM), celebrada esta semana en Naciones Unidas, Jens Stoltenger, primer ministro de Noruega, señaló el rotundo fracaso en el mundo para lograr avances sustanciales en la reducción del número de muertes maternas por embarazo o al dar vida, el Objetivo número 5 fijado por la comunidad internacional hace ocho años.
Al participar en el debate de alto nivel de Naciones Unidas en Nueva York, indica un comunicado de prensa, Jens Stoltenger dijo que estaba claro que el mundo no está tomando en cuenta el asunto de la mortalidad materna, uno de los ocho ODM.
El hecho de que no hayamos hecho un significativo progreso en la reducción en la muerte de mujeres embarazadas, “es atroz, terrible, vergonzoso”, dijo a los delegados. “Sólo puede haber una razón para esta situación “espantosa” y esta es, la persistente negligencia, descuido a las mujeres, en un mundo dominado por los hombres. Stoltenberg dijo: "Esta tragedia humana es evitable por su simple significado".
El reporte que dio a conocer la semana pasada el Fondo de las Naciones Unidas para la Infancia (por sus siglas en inglés UNICEF), mostró que más de 500 mil mujeres mueren innecesariamente cada año por complicaciones de embarazo, la mayoría de éstas en países en vía de desarrollo.
Sólo piensen en los millones de mujeres, mujeres jóvenes y niñas que saben, y con miedo, que dar vida puede causarles la muerte, dijo el Primer Ministro. “El dinero no parece ser un problema cuando el problema es el dinero”, refiriéndose a la crisis del Wall Street y mercados financieros alrededor del mundo.
Existe la inversión en casas y trabajos para la clase media. Ahí hay algo fundamentalmente mal cuando el dinero parece ser abundante, pero escaso cuando se trata de fondos para invertir en la gente.
Stoltenberg hizo un llamado fuerte a nivel internacional para atender este problema, así como para destinar fondos a proyectos de construcción de escuelas en Afganistán y apoyo a hospitales en Rwanda, y para vacunas para la población más pobre en el mundo.
Al referirse a los esfuerzos hechos por los países miembros de Naciones Unidas para reducir el hambre, la pobreza extrema, las enfermedades y el analfabetismo, el Secretario General del organismo, Ban Ki-moon, señaló que son importantes pero insuficientes, y requieren un mayor impulso para alcanzar los Objetivos del Desarrollo del Milenio (ODM), fijados hace ocho años por la comunidad internacional.
Durante la Reunión de Alto Nivel sobre los Objetivos de Desarrollo del Milenio, que se celebró esta semana en Naciones Unidas, Ban Ki-moon añadió “nos movemos en la dirección correcta, pero no lo suficientemente rápido”.

UNIFEM has released a publication that will be integral in holding governments and organizations accountable to their commitments in improving women's rights. Secretary-General Ban Ki-moon says:
"If any man asks why I support better accountability to women, here's my response: because a government that answers to women will answer to you, too."
UNIFEM largely blames the severe lack of improvement in gender quality within various nations on an "accountability crisis." Women should have the right to ask for explanations, to ask for information from decision makers - if they can't simply ask and be answered to, where can we even start implementing change?

U.S. Attorney General Grants Seton Hall Law Petition to Stop the Deportation of Victims of Genital Mutilation
NEWARK, N.J., Sept 26, 2008 /PRNewswire-USNewswire via COMTEX/ -- Attorney General Michael Mukasey granted the petition of the Center for Social Justice at Seton Hall Law School to reverse a recent decision by the Board of Immigration Appeals that denied asylum to victims of female genital mutilation (FGM). Joined by U.S. Representatives Steven Rothman (D-Bergen) and Chris Smith (R-Mercer), and a coalition of law professors, legal experts, and medical professionals, Seton Hall Law had called on the Attorney General to reverse what the Attorney General agreed was a decision based upon "flawed reasoning." The overturned decision was inconsistent with its own rulings in prior cases involving FGM, and legal experts had feared that it would result in a significant reversal of U.S. policy on the treatment of women in the asylum process.
Female genital mutilation is a traditional practice in many developing countries whereby women and girls are forcibly subjected to the cutting and/or removal of their genitalia, often resulting in a lifetime of serious health problems, including the risk of death at childbirth. On September 27, 2007, the Board of Immigration Appeals, the federal agency responsible for the interpretation of federal immigration law, issued a precedent-setting decision which held that women who have been subjected to FGM have no claim to asylum because they already have experienced the procedure and, therefore, have no reason to fear its repetition. The Board does not apply similar reasoning to victims of other types of persecution. U.S. Attorney General Michael Mukasey reversed that decision.
"The Attorney General got it right. The Board's decision was terribly flawed," said Jenny-Brooke Condon, Assistant Clinical Professor at the Center for Social Justice. "The Board had misconstrued the nature of FGM, failing to recognize that FGM is not a one-time act, but is often a lifetime sentence in a woman's society of origin. After the inhumane and life-threatening procedure takes place, victims of FGM are often subjugated in their societies and marriage and deprived of sexual identity."

DNA Crime Bill Helps Take Rape Kits off the Shelves and Criminals off the Streets
Washington, DC * Today, the Senate passed Senator Joseph R. Biden, Jr.'s (D-DE) Debbie Smith Reauthorization Act of 2008, legislation designed to help eliminate the nationwide backlog of rape evidence kits and bolster DNA testing of criminals and crime scene evidence. The original law * authored by Sen. Biden and set to expire at the end of FY 2009 * helped standardize the evidence collection of kits for sexual assaults, making it easier to enter the information into state and national databases. The law also provided funds to help forensic labs process the DNA evidence and compare the DNA samples with those taken from criminals. Today's reauthorization bill would extend the important program through 2014 and help solve thousands of rapes and other violent crimes.
It is estimated that 40 percent of the unsolved rape cases could be solved by taking the DNA sample collected after a sexual assault and comparing it to the existing DNA databases of convicted felons and rapists. The U.S. Department of Justice has estimated that there are at least 221,000 rape kits currently on the shelves in evidence lockers, untested and gathering dust. The Debbie Smith Grant Program has helped alleviate some of the backlog and has expanded testing to solve more crimes, but much more needs to be done.
"If there's a rape kit left sitting on a shelf, there's a victim without justice. This program must be kept alive until the backlog numbers total zero," said Senator Biden. "It is unconscionable that we have the ability to solve these crimes and hold the perpetrators responsible, but because of red tape and lack of funding, the criminals are free and their victims continue live in fear. In the past five years, we've made headway in the backlog, but we still have a long road to go before it is eliminated."
After holding Judiciary Committee hearings on the backlog of rape kits waiting to be tested, Sen. Biden introduced and Congress passed the Advancing Justice Through DNA Act in 2004 to help states eliminate their DNA backlog and allow law enforcement greater leeway to indict unnamed individuals using their DNA profile.
The bill was named for Debbie Smith, a Virginia woman who was raped near her home in 1989 and lived in fear until a crime laboratory discovered a DNA match between the rape scene evidence and a State prisoner's DNA sample. That match gave Mrs. Smith her first moment of real security and closure, and since then she has traveled the country to advocate on behalf of assault victims and champion the use of DNA to fight sexual assault.
The Debbie Smith Reauthorization Act of 2008 provides:
$151 million per year for the Debbie Smith DNA Backlog Grant Program to eliminate the current backlog of unanalyzed DNA samples in the nation's crime labs. This money will provide federal grants to state and local governments over the next six years for DNA analysis of unprocessed evidence in rape cases;
$12.5 million per year for the DNA Sexual Assault Justice Act help local law enforcement agencies put the DNA profiles of convicted felons into state and national databases. It also provides training grants to help ensure that nurses, police and paramedics know how to best collect and preserve DNA evidence in sexual assault cases; and
$30 million per year for the Sexual Assault Forensic Exam Grants to ensure that there are trained and equipped personnel to assist with the treatment and examination of sexual assault victims, including Sexual Assault Nurse Examiners (SANE) and Sexual Assault Forensic Examiners (SAFE).

Other duties include recruiting and training student peer educators and interns; developing and facilitating the Rape Awareness Seminar; providing crisis intervention, advocacy, and referrals; developing, marketing and publicizing programs; and other duties as required.

At least one rape and kidnapping of two women are reported daily in Punjab. A woman is murdered every third day and at least one case of molestation is registered every day. At least 12 women commit suicide every month and the same number are killed for dowry.
If the Punjab State Women’s Commission figures on crime against women are to be believed, women continue to be unsafe in Punjab with rapes and kidnappings showing a rise in the past one and a half years. Crime figures with the police show a sorry picture of safety of women in Punjab.
Kidnapping cases of women registered in 2007 was over 600. Kidnappings in the state are on the rise. From 30 to 35 kidnappings a month in the first quarter of 2007 the number rose to 50 to 65 a month till the last months of the year when the number fell to about 45.
In June 2007, kidnapping cases touched 70 figure. Jalandhar and Ludhiana reported the highest kidnappings. These two districts account for over 70 per cent of kidnappings in the state. The kidnappings reflect efficiency of the police. Till July 31, women kidnapped were 320, an average of over 40 a month.
In 2007, 140 women were murdered in the state, while till July 31 this year the number was 85. Last year in May 2007, five women were murdered in Bathinda alone and four in Patiala in September 2007. This year in June, five women were murdered in Nawanshahr.
Dowry deaths also show an upward trend. In 2007 more than 130 women were killed for dowry and this year till July end the figure crossed 75. Ludhiana, Tarn Taran, Bathinda and Jalandhar were in the news for dowry deaths.
More than 430 women were raped in 2007. This year till July 31 the number crossed 225. In May this year 42 women were raped, in June the number went up to 44 and in July to 53. Ludhiana district alone accounted for almost 60 rape cases last year. The number of rape cases has been high in Jalandhar, Ferozepur, Hoshiarpur and Gurdaspur too.
As many as 158 women committed suicide in 2007 and this year till July 31, the number has touched 90. In May this year, 23 suicides were reported in Punjab of which four women committed suicide in Patiala and three women killed themselves in Sangrur.

Community Awareness Projects
The National Association of VOCA Assistance Administrators
(NAVAA), through a grant from the Office for Victims of Crime, is
seeking proposals for innovative and collaborative approaches to
promoting community-wide awareness of the rights and available services for victims of all types of crimes during National Crime Victims´ Rights Week (NCVRW), April 26 - May 2, 2009.
Approximately 56 communities will be awarded up to $5,000
each in reimbursement for approved NCVRW public awareness activities through the NCVRW Community Awareness Project. Public agencies, nonprofit organizations, community-based
victim service organizations, faith-based organizations, tribal
organizations, and community coalitions committed to
advocating for the rights and services of crime victims are
among those encouraged to apply.
Over the past 5 years, the NCVRW Community Awareness
Project has aided more than 300 communities to raise general
public awareness about victims´ rights and services. Within many
of these communities, "traditional" NCVRW events were enhanced by the collaborative partnerships that were formed during the planning phase of each project.

Examples of allowable costs include the following: purchase of

to promote NCVRW events, victims´ rights, and available services; design and print of promotional or educational materials; support for event speakers; design and print of
posters, invitations, and fliers; purchase of supplies, materials,
and equipment used in public awareness events and activities;
and rental of space to conduct NCVRW activities and events.
Salaries, overhead, entertainment, and fundraising costs are not
eligible for reimbursement.

La niña cautiva

No hay nombre, ni siquiera iniciales. Se sabe, en cambio, que tiene 12 años y está internada en un hospital de pediatría. No está enferma, está presa. Fue la presa del hombre que la violó y ahora de los “expertos” que dirimen su destino. Presa de la química de su cuerpo que no entiende de deseos y organiza una vida que podría convertirse en un hijo o no, llegue a término el embarazo o no. Ella no puede decidir sola, casi nadie decide sola en esos casos, aunque la última palabra sea dicha en la intimidad. Es necesario, lo sabemos las mujeres, contar con la confianza de alguien más, sentirse escuchada, poder expresar las dudas, sin convertir a las dudas en una bandera robada al enemigo. Dicen las crónicas que la niña ya no está segura de querer abortar, sobre todo después de que le mostraran imágenes de fetos mutilados, de que pusieran sobre su cama de hospital un manto de culpa para que ella lo cargue si decide imponer la voluntad de que la violación no se convierta en hijo. O en niño entregado en adopción, como se sugiere, un hijo para otros, para los buenos, los que se arrogan la certeza de la sacralidad de la vida. Aunque desprecien la vida de la niña, cautiva en un hospital de pediatría. Ella no puede decidir sola y aun si pudiera, no le está permitido. Su decisión fue expropiada en el mismo momento en que un hombre mayor, ahora detenido, se metió entre sus piernas para imponerle una lección ancestral que los hechos siguen acuñando y que la gran mayoría de las mujeres recibimos alguna vez: tu cuerpo no es completamente tuyo, está para servir. A la voluntad de ese hombre, por ejemplo. Para servir a la reproducción, por ejemplo.
Los expertos se reúnen y observan a la niña. Indagan sobre ella, buscan dimensionar el tamaño de su dolor y evalúan los daños por venir como si analizaran las grietas en una casa sacudida por un terremoto. ¿Qué estará haciendo la niña mientras tanto? ¿Mirará dibujitos en la tele? ¿Recibirá visitas de sus amigos y amigas? ¿Extrañará el barrio, la escuela, su casa? A su madre le quitaron la guarda. A la madre que habló por ella, que reclamó por ella, le cerraron la boca; le dijeron, de alguna manera, que no puede ser madre. Le dejaron, también, la culpa servida en bandeja. ¿O no era su concubino el que abusó de su hija? Había denuncias por violencia en contra del hombre, denuncias que seguramente hizo la madre. Lo que hizo el Estado con esas denuncias no se sabe, pero eso no le ha quitado potestad sobre la vida y el futuro de la niña. El Estado, en cambio, organiza el secuestro en una cama de hospital, convoca a los expertos, dilata el desenlace, morosamente deja hablar a las morales en pugna; que libren su batalla sobre el cuerpo de la niña, igual ese cuerpo está custodiado, intervenido por el régimen hospitalario. A tal hora se duerme, a tal se despierta, se lava, se alimenta. Todo bien supervisado, ordenado, desinfectado.
¿Quién duerme a la noche junto a la nena de 12 años? ¿Quién le dice que todo va a pasar, que no tenga miedo?
El embrión, ahora, tiene un tutor. El tutor podría, por ejemplo, invocando el bien superior de su tutelado obligar a la niña a comer espinacas, cucharadas de germen de trigo o lentejas. Al fin y al cabo es por su boca, por sus sistemas vitales, por su cuerpo que el embrión tutelado se alimenta. El juez que mantiene a la niña cautiva en el hospital, de todos modos, considera que hay dos personas en ese cuerpo y a cada una le impuso un tutor. Dice el juez que la nena “no quiere matar al bebé”. Ahora el juez parece que la escucha, que necesita tantos expertos porque la nena ha hablado. ¿O habrá en esa frase una traducción de la moral del magistrado al que le importa un cuerno la jurisprudencia, la ley y lo que significa, a los 12, convertirse en madre. Aunque tal vez no se convierta en madre, tal vez alcance con que la nena ponga su cuerpo para la gestación y el parto y después la suerte dirá.
La nena no puede salir del hospital y sobre su cuerpo ahora hay una doble tutela. Un desconocido sobre ese enigma que gesta, su abuela sobre ella. Su voluntad no cuenta, su cuerpo ha sido expropiado.
Y lo peor es que la historia inaugura ningún relato. Apenas vuelve a bordar sobre la superficie del cuerpo de las mujeres en general una lección ancestral que la mayoría hemos escuchado y que dice que nuestro cuerpo no nos pertenece del todo. Es posible quedar presa de las pugnas morales de otros, ser apropiada su capacidad reproductiva, juzgadas sus decisiones o directamente obturadas. El dinero otorga algunas libertades, es cierto. Aquí no habría historia si hubiera habido recursos para pagar un aborto clandestino, limpio, silencioso; uno como los que se practican todos los días, sin jueces, sin expertos, sin más dilema moral que el que cada mujer pone en juego cuando le toca decidir sobre su cuerpo, su vida, su futuro. En la clandestinidad, claro, donde se esconde lo que no se quiere nombrar. Aunque en ello se vaya la vida; la vida de las otras.

Women to rule Rwanda parliament
Rwanda will be the first country where women will outnumber men in parliament, preliminary election results show.
Women have taken 44 out of 80 seats so far and the number could rise if three seats reserved for the disabled and youth representatives go to females.
Rwanda, whose post-genocide constitution ensures a 30% quota for female MPs, already held the record for the most women in parliament.
The ruling party coalition won 78% of seats in Monday's vote.
Indirect elections for women's quota seats took place on Tuesday and votes for two youth representatives and a disabled quota seat are taking place on Wednesday and Thursday.
It is the second parliamentary elections since the genocide of 1994 when some 800,000 minority Tutsis and moderate Hutus were slaughtered by Hutu militias in just 100 days.

Puebla: mujeres policías víctimas de abuso sexual por jefes

Puebla, Pue., 22 sep 08 (CIMAC).- La presidenta de la Comisión de Derechos Humanos del Congreso de Puebla, Carolina O´Farril Tapia, informó que recibió el reporte de tres mujeres policías que fueron violadas por sus propios jefes de trabajo, pero podrían ser cinco.
O´ Farril, diputada del Partido Convergencia, anunció que la comisión que preside ya está actuando, aunque destacó que las violaciones no han sido denunciadas ante el Ministerio Público porque las víctimas tienen miedo a las represalias.
Detalló que en este hecho se implican dos jefes policiales y a un juez de lo Civil, quienes decidieron despedir a las mujeres. Por esto, la única denuncia que las afectadas se animaron a presentar fue en el aspecto laboral, sin embargo, puede probarse la violación, sentenció.
Para Carolina O´Farril, “la discriminación hacia las mujeres en sus centros de trabajo, el acoso sexual y hasta violaciones por parte de sus compañeros o jefes son un ejercicio cotidiano, estos casos lo muestran”.
La diputada de Convergencia ve similitud entre el suceso y los que se registraron en el DF que tuvieron origen cuando los varones observaron que sus compañeras de trabajo eran igual de eficientes que ellos.
“A los policías municipales les desagrada que sus compañeras puedan obtener un nivel superior”, señaló, y explicó que en el terreno del abuso sexual es donde ellos intentan ejercer el poder, adujo.
Ante este escenario, refirió que no sólo pedirá el apoyo de sus compañeras y compañeros legisladores, sino también el de los representantes de la Procuraduría General de Justicia con el fin de que tales hechos no queden impunes y se castigue a los responsables.
Por cuestiones de seguridad no proporcionó los nombres de las personas afectadas ni de los agresores, tampoco los municipios en donde ocurrieron estos hechos, solamente se limitó a decir que son demarcaciones en la zona metropolitana de Puebla.

Sin recursos 90 por ciento de refugios para víctimas de violencia

México DF, 22 sep 08 (CIMAC).- A punto de concluir el año fiscal 2008, los refugios que atienden la violencia contra las mujeres operaron sin recursos, ya que los 200 millones de pesos (mdp) asignados para este año aún no han sido entregados.
Y aunque en una revisión hecha al Presupuesto 2008 por la Comisión de Equidad y Género de la Cámara de Diputados aparece la entrega de 52 mdp, ni siquiera este monto ha sido repartido, denunció hoy la diputada Martha Tagle Martínez, integrante de la Comisión de Equidad y Género de la Cámara de Diputados.
Entrevistada al término de la inauguración del Seminario Internacional Estándares de calidad en la atención de refugios, que se realiza hoy y mañana, Tagle Martínez enfatizó que como cada año, existen subejercicios en los programas destinados a mujeres y uno de ellos es el de refugios.
“Hemos hablado con todo mundo y a la fecha ni siquiera esos 52 millones han bajado a los refugios que son 29, el problema del subejercicio no se debe a las acciones como tales sino a todas las trabas burocrática y administrativas que hay para bajar estos recursos”, denunció.
Al respecto, Margarita Guillé Tamayo, directora de la Red Nacional de Refugios, que concentra 38 refugios de sociedad civil en el país, confirmó que en lo que va del año, el 90 por ciento de los refugios no han recibido los financiamientos etiquetados para poder operar y el 35 por ciento se encuentra en riesgo de cerrar.
La Red Nacional de Refugios es una asociación civil, constituida legalmente en 2004, que agrupa a diversos refugios ubicados en los estados de la República Mexicana, ya sean organizaciones sociales o gubernamentales o de la sociedad civil. En ellos se brinda atención especializada y protección a mujeres con sus hijas o hijos que viven en situación de violencia.

Revealed: UK’s first official sharia courts

ISLAMIC law has been officially adopted in Britain, with sharia courts given powers to rule on Muslim civil cases.
The government has quietly sanctioned the powers for sharia judges to rule on cases ranging from divorce and financial disputes to those involving domestic violence.
Rulings issued by a network of five sharia courts are enforceable with the full power of the judicial system, through the county courts or High Court.
Previously, the rulings of sharia courts in Britain could not be enforced, and depended on voluntary compliance among Muslims.
It has now emerged that sharia courts with these powers have been set up in London, Birmingham, Bradford and Manchester with the network’s headquarters in Nuneaton, Warwickshire. Two more courts are being planned for Glasgow and Edinburgh.
Sheikh Faiz-ul-Aqtab Siddiqi, whose Muslim Arbitration Tribunal runs the courts, said he had taken advantage of a clause in the Arbitration Act 1996.
Under the act, the sharia courts are classified as arbitration tribunals. The rulings of arbitration tribunals are binding in law, provided that both parties in the dispute agree to give it the power to rule on their case.
Siddiqi said: “We realised that under the Arbitration Act we can make rulings which can be enforced by county and high courts. The act allows disputes to be resolved using alternatives like tribunals. This method is called alternative dispute resolution, which for Muslims is what the sharia courts are.”
The disclosure that Muslim courts have legal powers in Britain comes seven months after Rowan Williams, the Archbishop of Canterbury, was pilloried for suggesting that the establishment of sharia in the future “seems unavoidable” in Britain.
In July, the head of the judiciary, the lord chief justice, Lord Phillips, further stoked controversy when he said that sharia could be used to settle marital and financial disputes.
In fact, Muslim tribunal courts started passing sharia judgments in August 2007. They have dealt with more than 100 cases that range from Muslim divorce and inheritance to nuisance neighbours.
It has also emerged that tribunal courts have settled six cases of domestic violence between married couples, working in tandem with the police investigations.
Siddiqi said he expected the courts to handle a greater number of “smaller” criminal cases in coming years as more Muslim clients approach them. “All we are doing is regulating community affairs in these cases,” said Siddiqi, chairman of the governing council of the tribunal.
Jewish Beth Din courts operate under the same provision in the Arbitration Act and resolve civil cases, ranging from divorce to business disputes. They have existed in Britain for more than 100 years, and previously operated under a precursor to the act.
Politicians and church leaders expressed concerns that this could mark the beginnings of a “parallel legal system” based on sharia for some British Muslims.
Dominic Grieve, the shadow home secretary, said: “If it is true that these tribunals are passing binding decisions in the areas of family and criminal law, I would like to know which courts are enforcing them because I would consider such action unlawful. British law is absolute and must remain so.”
Douglas Murray, the director of the Centre for Social Cohesion, said: “I think it’s appalling. I don’t think arbitration that is done by sharia should ever be endorsed or enforced by the British state.”
There are concerns that women who agree to go to tribunal courts are getting worse deals because Islamic law favours men.
Siddiqi said that in a recent inheritance dispute handled by the court in Nuneaton, the estate of a Midlands man was divided between three daughters and two sons.
The judges on the panel gave the sons twice as much as the daughters, in accordance with sharia. Had the family gone to a normal British court, the daughters would have got equal amounts.
In the six cases of domestic violence, Siddiqi said the judges ordered the husbands to take anger management classes and mentoring from community elders. There was no further punishment.
In each case, the women subsequently withdrew the complaints they had lodged with the police and the police stopped their investigations.
Siddiqi said that in the domestic violence cases, the advantage was that marriages were saved and couples given a second chance.
Inayat Bunglawala, assistant secretary-general of the Muslim Council of Britain, said: “The MCB supports these tribunals. If the Jewish courts are allowed to flourish, so must the sharia ones.”

Aído presentará a ONG las líneas de trabajo del Plan de trata con fines de explotación sexual
La ministra de Igualdad, Bibiana Aído, se reunirá el próximo martes, 23 de septiembre, con diferentes organizaciones para presentarles las líneas de trabajo del 'Plan Integral para la lucha contra la trata con fines de explotación sexual', con motivo de la celebración del Día Internacional contra la explotación sexual y el tráfico de personas.
El Plan tiene como objetivos principales, la lucha contra la trata y sus causas a través de políticas de seguridad y cooperación, el desarrollo de una red de asistencia integral para las víctimas y la puesta en marcha de campañas de sensibilización social, según informó hoy el Ministerio de Igualdad en un comunicado.
Así, señala que esta iniciativa responde a las recomendaciones realizadas por la Comisión Mixta Congreso-Senado de los Derechos de la Mujer y asegura que para su elaboración el Gobierno ha contado con la participación de "múltiples" instituciones, organismos y organizaciones de la sociedad civil que luchan contra la trata de personas.
Las medidas sobre las que se trabaja para la elaboración de este plan incluyen la prevención, la sensibilización social, la educación, la formación, la coordinación, la cooperación y la asistencia y protección de las víctimas, así como medidas legislativas que mejoren y sistematicen la actuación en esta materia.
Seis ministerios están implicados en este plan, coordinados desde el de Igualdad: Interior, Justicia, Trabajo e Inmigración, Asuntos Exteriores y Cooperación, Educación, Política Social y Deporte. Además, la ministra de Igualdad tiene previsto consultar las líneas de trabajo del plan con organismos europeos como la OSCE (Organización para Seguridad y Cooperación en Europa).

Labour conference: Total ban for sex soliciting and kerb-crawling

Kerb-crawling and soliciting for prostitutes on the streets are to be
outlawed as part of a wide-ranging tightening of the law, the home
secretary, Jacqui Smith, annnounced yesterday.
Warning of the "blight" of prostitution, Smith outlined a three-point plan at the Labour conference that will:
* Remove the requirement that only persistent kerb crawlers and men
who solicit on the street can be prosecuted. An alternative
requirement for kerb-crawlers - that they act "in a manner that is
likely to cause annoyance to people in the neighbourhood" - is also to
be removed. The changes will mean that kerb-crawlers and men
soliciting sex on the street can be prosecuted after a first offence.
* Give new powers to councils and the police to close down brothels
for at least three months if prostitutes are being run by a pimp or have been trafficked. At the moment, police can only close brothels if there is anti-social behaviour and if Class-A drugs are involved.
* Change the law so that men can be prosecuted if they pay for sex
with women who are exploited - "controlled for another person's gain", as Smith said. Currently, police can only pursue a prosecution if they can prove that the women did not consent to sex, which means they have
to compile evidence of rape.
The home secretary also announced that communities will be given more say in lap-dancing clubs opening in their areas. Smith criticised the Tories for sending delegates to their conference in Birmingham next week a £10 voucher to visit such a club. "I want to know what the Tories have to say for themselves," she said.
Smith announced the new measures on prostitution after a six-month government review into prostitution that focused on how Sweden and the Netherlands deal with the problem.
"We will do more to tackle the blight of street prostitution," Smith
told the Labour conference in Manchester. "At the moment only
persistent kerb-crawling is outlawed. In my book, once around the block is once too many - and so we'll make kerb-crawling punishable as a first offence."
The government will also toughen the law to prosecute men who pay for sex with women who are run by a pimp or who have been trafficked.
Harriet Harman, Labour's deputy leader who is also equality minister,
said: "We must protect women from being victims of human trafficking -
the modern slave trade. The trade only exists because men buy sex, so
to protect women we must stop men buying sex from the victims of human
trafficking."
Labour focused the first full day of its conference on crime and the
law. Jack Straw, the justice secretary, announced a crackdown on "no
win, no fee" lawyers, who have ramped up their fees in recent years,
and on legal aid solicitors.
"I am concerned about 'no win, no fee' arrangements," Straw said.
"It's claimed they have provided greater access to justice but the
behaviour of some lawyers in ramping up their fees in these cases is nothing short of scandalous."
Turning his attention to legal aid lawyers - more money is spent on
legal aid in England and Wales than anywhere else in the world - Straw said: "There are now three times as many lawyers in private practice but paid for by the taxpayer as there were three decades ago; the budget has grown faster than the health and education services.
"The challenge now is how better to spend these huge sums in the
interests of justice; something I want to do with the legal profession
and local government."
Straw's crackdown on lawyers is part of a campaign to open up the
justice system as he strives to lift the "veil" on justice. "It's
about a change of culture, of attitude, about lifting the veil which
sometimes keeps justice from view," he said.

IT HAPPENED TO ALEXA FOUNDATION
OFFERING FINANCIAL SUPPORT AND A BETTER CHANCE AT JUSTICE FOR VICTIMS OF VIOLENCE
The purpose of the It Happened to Alexa Foundation is to help support rape survivors through the trauma of the criminal trial, in the hopes that more survivors will go through with the prosecution in order to put these perpetrators behind bars. Established in 2003, the foundation assists rape victims’ families with travel expenses during the litigation process and is the only organization of its kind in the United States.
The It Happened to Alexa Foundation (IHTAF) was born out of a personal and familial tragedy. The foundation was started by my parents, Tom and Stacey Branchini, after I was raped during my first week of college by a man who had broken into my dorm. Obviously the attack itself was horrifying, but the constant travel from my home in Western New York to the courthouse in Boston took its toll as well. We soon realized that most families could not afford to fly back and forth for every court hearing, or every time a judge granted a continuance, and then pay for a place to stay during a trial that may last weeks.
Unfortunately, many victims simply cannot afford justice, meaning they cannot afford travel expenses or things like taking time off from work or having a loved one attend the trial to provide emotional support. I can attest to the importance of having supporters present during the trial. The accused has the right to have supporters in court. However, for victims who are attacked away from home, it may be fiscally impossible to have their loved ones present. Having support at the time of trial can mean the difference between a successful prosecution and a not guilty verdict or an unfair plea bargain. When an accused criminal realizes a victim cannot afford travel and support expenses, he can use that information to seek dismissal of the charges or
a reduced sentence. IHTAF believes that no person should be a victim of unequal justice because they couldn’t afford to attend the trial or have a loved one there to help.
IHTAF is making a real difference. By easing some of the burdens endured by victims, we have noticed a dramatic improvement in guilty verdicts, guilty pleas and longer sentences in the cases in which IHTAF has been involved.
The Foundation has funds available right now to defray the cost of lodging and travel expenses, for the victim and a relative or trusted friend. Our ultimate goal is to alleviate some of the stress on victims who, by testifying in court, ensure that criminals are brought to justice, which helps keep all of us safe.
By providing financial assistance in particular for sexual violence cases, we at the Alexa Foundation know first hand that the system is working better because research shows that such victims are more likely to come forward when they know that they will not be alone during the process.Â
IHTAF offers money, and so much more. It offers hope to all who have suffered unspeakable crimes that justice will be served.
