Prevé sancionar violencia contra las mujeres
Nueva Constitución de Bolivia habla sobre equidad de género

México DF, 6 febrero 09 (CIMAC).- Mañana sábado entra en vigor la nueva Constitución socialista indigenista de Bolivia, en donde se habla sobre los principios de igualdad de género y derechos para la mujeres, como el derecho a una maternidad segura y la remuneración salarial equitativa.
La puesta en marcha de la nueva norma se hará en un acto conmemorativo con desfile militar, policías y representantes de las 36 naciones originarias de Bolivia.
A decir de algunas Organizaciones de la Sociedad Civil (OSC) del país, esto se debe a un gran esfuerzo de las mujeres bolivianas, trabajadoras que lucharon en la incorporación de sus derechos en el espacio constitucional.
Sin embargo, otras organizaciones feministas, como Mujeres Creando, consideran que la nueva norma que quedó muy por debajo de las expectativas y necesidades de la población femenina del país; más aún, consideran que la Constitución tiene una visión masculinizada (Cimacnoticias, 23-enero-09).
La Carta Magna Andina señala la adopción de medidas necesarias para prevenir y sancionar la violencia en contra de mujeres, además de que garantiza la estabilidad laboral en período de embarazo hasta el primer año de vida del hijo o la hija, señala la Agencia Latinoamericana de Información (ALAI).
Entre los cambios en la Carta Magna boliviana, sometida al voto popular el 25 de enero, destaca la prohibición y sanción de toda forma de discriminación fundada en razón de sexo, color, edad u orientación sexual.
La disposición también incorpora la prohibición de la discriminación por nacionalidad, credo religioso, ideología, filiación política o filosófica, estado civil, condición económica o social, tipo de ocupación, grado de instrucción, discapacidad, embarazo, u otras que tengan por objetivo o resultado anular o menoscabar el reconocimiento, goce o ejercicio, en condiciones de igualdad, de los derechos de toda persona.
En el Artículo 15 se establece que todas las personas, en particular las mujeres, tienen derecho a no sufrir violencia física, sexual o psicológica, tanto en la familia como en la sociedad.
“El Estado adoptará las medidas necesarias para prevenir, eliminar y sancionar la violencia de género y generacional, así como toda acción u omisión que tenga por objeto degradar la condición humana, causar muerte, dolor y sufrimiento físico, sexual o psicológico, tanto en el ámbito público como privado”, indica la Carta Magna.
Asimismo, en el Artículo 66 se garantiza a las mujeres y a los hombres el ejercicio de sus derechos sexuales y reproductivos, mientras que el Artículo 45, se indica que las mujeres tienen derecho a la maternidad segura, con una visión y práctica intercultural; gozarán de especial asistencia y protección del Estado durante el embarazo, parto y en los periodos prenatales y posnatales.
EMPLEO
En materia laboral, el Artículo 48, indica que el Estado promoverá la incorporación femenina a las fuentes de empleo con el principio de remunerarlas igual que a los hombres por un trabajo de igual valor ya sea el sector público o privado.
En tanto que el Artículo 338, establece que el Estado reconoce el valor económico del trabajo del hogar como fuente de riqueza y deberá cuantificarse en las cuentas públicas.
De igual manera, la Constitución Boliviana estipula los derechos de las familias y sus integrantes; en su Artículo 62, el Estado reconoce y protege a las familias como el núcleo fundamental de la sociedad, y garantizará las condiciones sociales y económicas necesarias para su desarrollo integral.
Mientras que en el Artículo 63 queda establecido que el matrimonio entre una mujer y un hombre se constituye por vínculos jurídicos y se basa en la igualdad de derechos y deberes de los cónyuges. Las uniones libres o de hecho tendrán los mismos efectos que el matrimonio civil, tanto en las relaciones personales y patrimoniales de los convivientes como en lo que respecta a las hijas e hijos adoptados o nacidos de aquéllas.
La nueva Constitución boliviana también suscribe beneficios universales en materia de acceso a servicios básicos, educación, salud, autonomías y estructura del Estado.

Job Description
The main responsibility of the Senior Adviser is to strengthen the work of all agencies (UN, NGOs international and local) at country-level to prevent and respond to sexual violence during or immediately after conflict. Applicants should therefore have a good understanding of the issue of multi-sectoral programming to address gender-based violence in addition to a thorough understanding of the gender, protection and human rights aspects of conflict-affected and humanitarian settings.

Job Description
The Gender-Based Violence (GBV) Coordinator facilitates and coordinates rapid implementation of GBV programming in humanitarian settings. GBV programming is multi-sectoral, involving multiple organizations and actors, NGO and government implementing partners, UN agencies, and other national and international organizations which, between them, ensure a comprehensive prevention and response initiatives. The GBV Coordinator's duties include liaison and coordination with other organizations (coalition building), training and sensitization, programme planning, and monitoring and evaluation.

Obama's Faith Based Office an Insult to Women

Obama attended the annual National Prayer Breakfast yesterday and used the opportunity to tout the reconstitution and expansion of George W. Bush's Office on Faith Based Initiatives. In his remarks the president said he didn't want to favor one religion over another, or "even religious groups over secular groups." But in fact, that's just what he's doing.
National women's organizations have been lobbying Obama, who has said he is a feminist, to reopen the White House Office on Women's Issues. So far the answer is a big fat no - women's concerns will be under the already swamped Office of Public Liaison. That's a tiny shop that's chronically understaffed and overstretched. Even with the best intentions, there's almost no chance they can interface with women's advocates in a meaningful way, much less shape policy to overcome the many setbacks we inherited from the Bush years.
In a direct insult to women, George W. Bush closed the Clinton-era White House Office on Women's Issues in his first week, then ensconced the first-ever church/state liaison office in the same space. For our new president to "keep the faith" with religious groups while short-shrifting women is equally insulting. There is no doubt that women are responsible for his election. Females went for Obama by 56 percent to McCain's 43 percent, while men split their votes about evenly. The Jesus crowd, on the other hand, voted 60% against the president.
The newly constituted "office for faith-based programs and community partnerships" will be headed by Joshua DuBois, a 26-year-old Pentecostal preacher and Obama confidant, who will preside over a task force of 25 or so religious and community leaders. This group will give DuBois advice, which will presumably be passed on to the president.
To accord this advisory panel so much power, while relegating women to the margins, speaks volumes. Religious groups gained a lot from the Bush years - access to the White House, and millions of dollars in federal money, some of which was used to proselytize. And don't forget, almost all faiths consider women second class citizens; many actively campaign against affirmative action, the Women's Equality Amendment, the international human rights treaty for women known as CEDAW, and civil rights for gays and lesbians. Keeping this act going - even if it is broadened to include "community members" - is not the change women voted for.
It's not too late for President Obama to change his mind and give the majority - women - a place at the table by re-opening the White House Office on Women's Issues. If he really does support women as he claims, restoring the losses of the last eight years on reproductive rights, enforcement of Title IX, Medicaid funding, and employment protections should be given a higher priority than keeping the religious right happy for what promises to be a very short honeymoon.
Women's groups are elated that the Texans are finally out of the White House. But if the new president wants their continuing loyalty, he ought to follow some good ol' Texas advice: Dance with the one that brung ya.

Mujer esterilizada sin su consentimiento presenta demanda contra Chile en foro internacional
Exige reparación del daño
Compartimos un boletín del Centro de Derechos Reproductivos, de Nueva York, y Vivo Positivo, de Chile, que denuncia un caso de grave trasgresión de los derechos humanos sexuales y reproductivos de una mujer chilena, VIH+, esterilizada forzadamente en un hospital público. Anteriormente se habían denunciado casos similares en el país, pero solo en el ámbito nacional. Este es el primero que llega a los organismos internacionales de derechos humanos, con el fin de exigir una respuesta y una reparación del Estado.
El 2 de febrero de 2009 la ciudadana chilena F. S., diagnosticada con VIH, demandó al Estado chileno ante la Comisión Interamericana de Derechos Humanos por haber sido esterilizada sin su consentimiento en un hospital público tras dar a luz. En el recurso, presentado en nombre de F. S., de 27 años, por el Centro de Derechos Reproductivos y la agrupación chilena que ofrece servicios a personas que viven con VIH/SIDA, VIVO POSITIVO, se denuncia que esta fue esterilizada debido a su estatus seropositivo, sin que jamás los médicos hubiesen discutido el tema con ella ni solicitado su autorización. “Aparte de violar los derechos humanos más básicos de una mujer, la esterilización forzosa reviste especial gravedad cuando se comete en contra de personas vulnerables y dignas de mayor protección, como las mujeres que viven con VIH”, expresó Luisa Cabal, Directora del Programa Internacional del Centro de Derechos Reproductivos. “Es hora que el Estado chileno haga valer los derechos humanos de todos sus ciudadanos y adopte medidas concretas para garantizar que las mujeres que viven con VIH reciban servicios de salud reproductiva de calidad y que respeten su derecho a decidir sobre sus propias vidas”.

Dr. Ebadi's human rights organization was forcibly closed by the Iranian authorities in December when they raided her personal office and seized her writings, confidential legal files, and two computers amid claims of so-called tax evasion. An angry mob later in the month surrounded Dr. Ebadi's home and personal office chanting death threats against her and vandalizing her building. And now her former secretary has been arrested.

UW-Madison, through University Health Services, is recruiting a Violence Against Women Prevention and Training Coordinator for a U.S. Department of Justice Grant to address sexual assault, dating violence, domestic violence, and stalking (award number 2008-WA-AX-0003). This 2.5 year, .75 FTE position will implement a first-year online prevention education program and
provide and law nforcement/judicial affairs training on sexual assault and intimate partner violence. The goals of the grant award are to reduce the occurrence of sexual assaults/intimate partner violence, increase the reporting of these crimes, and enhance community responsibility for addressing violence against women through an integrated, collaborative
approach in four areas: prevention, perpetrator accountability, victim
services, and training/coordination. The position will report directly to
the project director and work closely with the grant advisory body.

Breaking the cycle of teen dating violence

The conference sponsor is the Sexual Assault Resource Service (SARS) at the Hennepin County Medical Center in Minneapolis, MN, with funding awarded by the Office for Victims of Crime, Office of Justice programs, U.S. Department of Justice, Grant Number 2006-VF-GX-K002.
We anticipate that 1,000 SART professionals from across the nation will gather in Seattle for this unique multidisciplinary training conducted by leading experts from each of the SART disciplines. The three−day conference will feature 57 workshops, five keynote addresses, an interactive improvisational presentation at the closing session, and an exhibition hall of non-profit and corporate exhibitors. The conference will provide a valuable learning experience for law enforcement, sexual assault nurse examiners (SANEs) and other medical examiners, advocates, prosecutors and crime lab specialists.

Uniformizarán atención a menores víctimas de violencia sexual para apoyarlos mejor
Lima, dic. 14 (ANDINA).- En el primer trimestre del año 2009 se uniformizarán los procedimientos de atención a las víctimas de violencia y abuso sexual para evitar la duplicidad de funciones y efectivizar los servicios que prestan en este campo los diferentes sectores del Estado. Así lo indicó el titular de la Dirección de Niñas, Niños y Adolescentes del Ministerio de la Mujer y Desarrollo Social (Mimdes), Javier Ruiz Eldredge.
Manifestó que a fin de hacer posible dicha decisión, vienen sosteniendo diversas reuniones representantes de cinco ministerios competentes: Justicia, Salud, Educación, Interior, Mimdes, además del Poder Judicial.
Detalló que dentro de las tres estrategias básicas del Mimdes para erradicar la violencia y el abuso sexual a menores se encuentran la prevención, la atención y la sanción a los responsables. En la segunda de ellas se ha puesto énfasis en lo que se ha denominado la “Ruta de Atención”.
Lo que se quiere, dijo, es que la víctima no tenga que estar exponiendo su cuerpo en varias instancias de atención, “a veces en las comisarías y en el Instituto de Medicina Legal cuando sólo le compete a esta segunda”. “Se quiere una atención adecuada y articulada”, agregó.
En ese sentido, destacó como un importante avance de parte del Estado (Ministerio Público) la instalación de las denominadas cámaras Gessel, de las cuales existen siete en el Perú.
“En dichas cámaras, la víctima sólo tiene que declarar en una sola entrevista y no varias como se solía hacer”, puntualizó el funcionario del Ministerio de la Mujer.
Avances
Destacó como esfuerzos del Estado la existencia de una red de servicios de las Defensorías del Niño y del Adolescentes, que en el Perú son 2,025. Asimismo, son importantes los módulos de Justicia, los wawa wasis, el programa MAMIS, las cámaras Gessel, los Juzgados de Familia, entre otros.
Igualmente, resaltó que el reciente reglamento sobre trata (explotación sexual) de personas está basado en la supremacía de los derechos humanos y la protección integral a las víctimas.

Nueva NOM deja a víctimas de violencia sexual sin derecho a decidir

México DF, 2 feb 09 (CIMAC).- Casos como el de Paulina, niña impedida por las autoridades panistas de Baja California para interrumpir legalmente su embarazo producto de una violación, podría repetirse, si se publica la NOM que la Secretaría de Salud (SS) aprobó el pasado 28 de enero y que obstaculiza los derechos sexuales y reproductivos de las mujeres.
Luego del caso Paulina, ocurrido en 1999, la Comisión Interamericana de Derechos Humanos (CIDH) pactó con el Gobierno mexicano, en 2006, por medio de un Acuerdo de solución amistosa, que haría una norma oficial para la adecuada atención a víctimas de violencia sexual y familiar, de tal forma que no sucedieran más. Pero la SS nunca la publicó.
La Norma Oficial Mexicana sobre violencia familiar, sexual y contra las mujeres (NOM-046) fue creada para la prevención y atención, para establecer criterios y observar la detección, prevención, atención médica y la orientación en materia de violencia familiar y sexual que se proporcione a las y los usuarios de los servicios de salud general, y en particular a quienes se encuentren involucrados en situaciones de violencia familiar y sexual.
El proyecto, aprobado el 21 de julio de 2008 por el Comité Consultivo Nacional de Normalización de Prevención y Control de Enfermedades, contenía los comentarios del Centro Nacional de Equidad de Género y Salud Reproductiva de la Secretaría de Salud y de otros expertos en el tema.
Consideraba la más reciente evidencia científica, los compromisos internacionales a los que está suscrito México y el marco jurídico, particularmente de derechos humanos, nacional e internacional.
Tenía un apartado especifico para el tratamiento de las mujeres afectadas por la violencia sexual, enfatizaba la obligación del personal de salud de proporcionarles anticoncepción de emergencia, o en su defecto, de informarles sobre las alternativas para la interrupción legal del embarazo en los términos de la legislación estatal aplicable y garantizarles este servicio médico si lo requirieran.
Ante el cuestionamiento de las OSC por el retraso en la publicación de la NOM en el Diario Oficial de la Federación, que debería haber ocurrido 15 días después de aprobada, la SS no respondió, pese a que la Coalición por la Salud de las Mujeres y otras organizaciones que trabajan en favor de los derechos sexuales y reproductivos denunciaron la demora.

New law supports equal pay, but contraceptives financing dropped from economic stimulus
(New York) - The new law supporting the right to equal pay is a major step forward for women, but dropping funds for contraceptives from the economic stimulus package will impede women's rights and cost more in the long run, Human Rights Watch said today.
The Lilly Ledbetter Fair Pay Restoration Act, the first bill President Obama signed, expands the time period for filing pay-discrimination claims. The victims, many of them women, were previously limited by a 2007 Supreme Court decision that said they could only file claims against their employer within 180 days of their first unfair paycheck, even if they did not learn of the problem until years later. Under the new law, claims can be filed within 180 days of receiving any discriminatory paycheck.
"This bill dramatically improves a woman's chance to fight pay discrimination," said Meghan Rhoad, researcher in the women's rights division at Human Rights Watch. "And it greatly improves the fairness of the system for everyone."
However, with President Obama's support, members of Congress removed provisions of the economic stimulus proposal that supported access to contraceptives. Human Rights Watch understands that the provisions, which would have allowed states to expand access to contraceptives under Medicaid, were taken out after protests from some congressional members. However, a 2007 Congressional Budget Office analysis of an almost identical proposal estimated that such funding for contraceptives would save $200 million over five years, including money Medicaid would otherwise have spent on services related to unintended pregnancies.
Access to contraceptives enables women and their families to make considered decisions about the number and spacing of their children. These decisions carry profound financial and other implications for families, and the decision not to expand access to contraception under Medicaid means that fewer families will be able to make those decisions, Human Rights Watch noted.
"Ensuring access to contraception is not only the right thing to do, it makes economic sense," said Rhoad.

There was no shortage of women at the gathering of the global elite in Davos this year. It's just that most of them were either delegates' wives, there to enjoy the skiing at the Swiss mountain resort while their menfolk got on with the serious business of mending the world economy, or upmarket usherettes dressed in smart, air-hostess-style blue uniforms, helping people find their seats.
The heavy-hitting women present? There was a handful, including Angela Merkel, the German leader, and Valerie Jarrett, who came as Barack Obama's representative. Skim the handbook containing the names of the invitees and you had to pass 20 men before coming to the first woman, who just happened to be Princess Inaara, Her Highness the Begum Aga Khan. On the abridged list of about 170 business leaders, I counted five women. As a delegate put it: "Men in well-cut suits still come first at Davos."
Does it matter that women are not getting on to the guest list of the biggest male ego-thon on the planet? After all, most females of sound mind would far rather be anywhere else. But the truth is that it does. It sure does.
The big theme at this year's World Economic Forum (WEF) was "Shaping the Post-Crisis World". The idea that that can be achieved while excluding half the population is breathtaking in its arrogance and shows that the male Davos elite remains mired in its own preening self-regard and complacency. They have wrecked the world economy, but seem oblivious to the idea they may not be the best people to rebuild it. Ignoring the contribution women can make is ridiculous at any time, but how much more so when there is a clear need to reflect on the macho, tooth- and-claw brand of capitalism that caused the crunch in the first place.
It's not just Davos, of course.

Río de Janeiro condena un anuncio en el que se maltrata a las modelos

Las vallas publicitarias han sido desplegadas en las ciudades italianas de Milán, Bolonia y Nápoles y sus fotos han sido divulgadas con indignación por la prensa escrita, de internet y la televisión brasileña.
Mientras, las autoridades turísticas del estado y del municipio de Río de Janeiro y la Policía Militar han protestado por la campaña y han pedido que sea retirada.
La propaganda de la marca italiana de ropa femenina 'Relish' muestra a las modelos, vestidas a la última moda, siendo cacheadas de forma violenta y con claras connotaciones sexuales por hombres que usan uniformes idénticos a los de la Policía Militar de Río de Janeiro.
Las escenas fueron fotografiadas en la playa de Ipanema, y aparecen en el fondo los también emblemáticos morros de la cordillera que bordea Río.

En las mangas de las camisa de los "agentes" se ven emblemas parecidos a la bandera azul y blanca de Río de Janeiro, como las insignias usadas en la vida real por los policías cariocas.
Otro hombre, que enfila su mano debajo de la falda de la modelo, la cual esta de cara al coche y con sus manos apoyadas en el lateral del mismo, exhibe en el uniforme lo que parece ser el escudo del Batallón número 22 de la PM, del norte de la ciudad.
El secretario de Turismo de Río de Janeiro y presidente de la empresa municipal de turismo Riotur, Antonio Figueira de Mello, emitió una nota de "repudio" a la campaña y dijo que enviará a la embajada de Italia una petición formal para que las imágenes sean retiradas de las calles de ese país.
