MUJERES-ARGENTINA: Justicia de género con juezas y jueces

BUENOS AIRES, 8 sep (IPS) - Para que Argentina tenga una justicia con perspectiva de género, más importante que superar el desequilibrio hombre-mujer a medida que se escala en el Poder Judicial, es garantizar la auténtica inclusión de ese enfoque en las sentencias, las dicten juezas o jueces, coinciden especialistas.

"La cantidad de mujeres que hay hoy en el Poder Judicial no nos satisface, pero si lo que se buscan son fallos con perspectiva de género, entonces lo que importa es la capacitación de jueces y juezas", distinguió para IPS Natalia Gherardi, directora ejecutiva del no gubernamental Equipo Latinoamericano de Justicia y Género (ELA).

Según Gherardi, tanto en Argentina como en los demás países de América Latina, la proporción de mujeres en el Poder Judicial "no es representativa de la cantidad que egresa de las carreras de derecho", donde desde hace 20 años y en forma sostenida son mujeres la mayoría de quienes obtienen el título de abogacía.

No obstante, son pocas las que llegan a las instancias superiores de este poder del Estado. De acuerdo al Informe sobre Género y Derechos Humanos 2005-2008 de ELA, lanzado el lunes 7, entre la Corte Suprema de Justicia de la Nación y sus homólogas en las 23 provincias, hay apenas 20 por ciento de juezas.

Ese promedio oculta conquistas recientes como la incorporación de dos magistradas a la Corte Suprema de Justicia de la Nación, y retrasos en siete provincias --30 por ciento del total-- donde no hay ninguna mujer en los máximos tribunales respectivos.

Los datos del estudio muestran que existe una "evidente segregación vertical" que mantiene a las juezas en instancias inferiores o en fueros tradicionalmente asociados a su género como el civil, el administrativo o el laboral. En cambio, son excepción en el fuero federal y en el penal, añade.

Violence has long been considered a criminal justice issue and a
human rights issue. More recently it also has been considered a
health issue. However, with the exception of some forms of organized violence, rarely is violence regarded as a development issue. Yet, in
many countries, violence between young people or the abuse of
women, children or the elderly seriously hampers economic and social development.

The impact of violence on development too often remains ignored by those who have
the possibility to act on it. This document makes the case for increased attention by
international development agencies to violence prevention. A key aim is to stimulate dialogue on the role of international development agencies in the prevention of violence globally, and ultimately to increase investment in a commonly agreed set of applied violence prevention strategies.

12-Year-Old Girl Dies While Giving Birth In Yemen

Yemen — A 12-year-old Yemeni child-bride died after struggling for three days in labor to give birth, a local human rights organization said Saturday.

Fawziya Abdullah Youssef died of severe bleeding on Friday while giving birth to a stillborn in the al-Zahra district hospital of Hodeida province, 140 miles (223 kilometers) west of the capital San'a.

Child marriages are widespread in Yemen, the Arab world's poorest country, where tribal customs dominate society. More than a quarter of the country's females marry before age 15, according to a recent report by the Social Affairs Ministry.

Youssef was only 11 when her father married her to a 24-year-old man who works as a farmer in Saudi Arabia, said Ahmed al-Quraishi, chairman of Siyaj human rights organization, which promotes the rights of children in Yemen.

Al-Quraishi said that he stumbled upon Youssef in the hospital while investigating cases of children who had fled from the fighting in the north.

"This is one of many cases that exist in Yemen," said al-Quraishi. "The reason behind it is the lack of education and awareness, forcing many girls into marriage in this very early age."

Impoverished parents in Yemen sometimes give away their young daughters in return for hefty dowries. There is also a long-standing tribal custom in which infant daughters and sons are promised to cousins in hopes it will protect them from illicit relationships, he said.

Al-Quraishi said there are no statistics to show how many marriages involving children are performed every year.

The issue of child brides vaulted into the headlines here two years ago when an 8-year-old Yemeni girl went by herself to a courtroom and demanded a judge dissolve her marriage to a man in his 30s. She eventually won a divorce, and legislators began looking at ways to curb the practice.

In February, parliament passed a law setting the minimum marriage age at 17. But some lawmakers are trying to kill the measure, calling it un-Islamic. Before it could be ratified by Yemen's president, they forced it to be sent back to parliament's constitutional committee for review.

Such marriages also occur in neighboring oil-rich Saudi Arabia, where several cases of child brides have been reported in the past year, though the phenomenon is not believed to be nearly as widespread as in Yemen

INFORME REVELA ATERRADOR AUMENTO DE VÍCTIMAS
Violencia doméstica: 50 mujeres muertas

Cifra de ocho meses de 2009 supera todo el año 2008

PANAMÁ. En ocho meses del año 2009, ha habido más muertes violentas de mujeres que las ocurridas en todo el año pasado.

Así lo revela un informe del Observatorio Panameño contra la Violencia de Género (OPVG), adscrito a la Defensoría del Pueblo.

Según el reporte, entre enero y agosto de este año, 50 mujeres fallecieron en Panamá, por situaciones relacionadas con hechos violentos.

De esta cifra, 35 casos pueden considerarse como “feminicidios”, de acuerdo con el reporte.

El informe del OPVG detalla que las provincias donde han ocurrido estos hechos la encabeza Panamá, cuya incidencia es del 72.5% de los casos de muertes violentas de mujeres, seguida de Colón con un 17.6% y Chiriquí con 5.9%. En tanto, las provincias de Los Santos y Chiriquí registran un 2% de las defunciones, respectivamente.

Las cifras indican que se ha producido un peligroso y progresivo aumento de casos de violencia contra la mujer.

En todo el año 2007, los casos de este tipo sumaron 36, mientras que el año pasado hubo 41 situaciones de violencia y muerte que involucraron a mujeres.

Otros datos reveladores del informe del OPVG es el método utilizado para matar a las mujeres, siendo las armas de fuego, seguido del arma blanca y los estrangulamientos los mecanismos más utilizados por los asesinos.

Al respecto, el defensor del Pueblo, Ricardo Vargas, precisó que la violencia de género ha ido en ascenso en los últimos tres años, y formuló un llamado a las autoridades para dar cumplimiento más efectivo a las normas sobre protección a las mujeres contra la violencia.

PROBLEMA CONTINENTAL

En materia de violencia doméstica, los datos que se manejan a nivel continental también son alarmantes.

De acuerdo con un estudio de la Universidad de Panamá, el 70% de las mujeres ha sido víctima de abuso físico, emocional o sexual por parte de su compañero, ya sea esposo, novio, o bien de un familiar.

El pasado 11 de junio, el gobierno panameño inauguró el Instituto Nacional de la Mujer (INAMU), creado mediante ley aprobada el año pasado, cuyo objetivo es luchar contra la violencia sexista, orientar a las víctimas y lograr la igualdad entre sexos.

Insurance Companies Consider Domestic Violence A Pre-Existing Condition

In the very low blow department–As I’ve pointed out before, the current system of health insurance in this country is hugely discriminatory against women, but what I somehow missed until today is that health insurance can be denied to victims of domestic violence in nine states and the District of Columbia because domestic violence is considered a pre-existing condition! No this isn’t a Granny Death Panel type rumor, it comes straight from a website run by the oh-so-radical Department of Health and Human Services.

As the Service Employees International Union (SEIU) blog puts it, “Words cannot describe the sheer inhumanity of this claim.”

The world will celebrate the 61st anniversary of the Universal Declaration of Human Rights on 10 December 2009. The University of Pretoria with the support of the Office of the High Commissioner for Human Rights (OHCHR) will, during the week leading up to the celebrations of 10 December, present the first World Human Rights Moot Court Competition. The Competition will focus on and carry further the theme identified by the OHCHR for the celebrations, namely ‘Discrimination’.

Violencia sexual aumenta casos de niñas embarazadas

Los casos de violencia sexual contra las mujeres aumentan a diario, y en particular las menores de 14 a 17 años resultan más afectadas, según Marta María Blandón, del organismo Ipas Centro América.

Blandón basó sus declaraciones en un estudio sobre violencia sexual que realizara el llamado grupo Católicas por el Derecho a Decidir, de acuerdo a un análisis cuantitativo de las noticias sobre violencia sexual publicadas en el 2008 en los periódicos LA PRENSA, Hoy y El Nuevo Diario.

El análisis, al menos de los datos de los medios de comunicación escritos, demostró que 318 mujeres fueron víctimas de actos de violencia física y sexual a nivel nacional, de las cuales 46 resultaron embarazadas por el agresor.

EMBARAZOS EN NIÑAS

Pero lo más relevante es que el 58 por ciento se ubicaba en el rango de los 14 a los 17 años. Esto demuestra que el 80 por ciento de las mujeres que resultaron embarazadas eran niñas menores de 17 años.

“Está presente el tema de la naturalización de la maternidad impuesta, todas las niñas son obligadas a ser madres a temprana edad, obligadas a ser madres de sus propios hermanos”, dijo Blandón.

Y es que, según el estudio, 36 de las víctimas fueron violadas y salieron embarazadas en primer lugar por sus propios padre (36.1 por ciento), seguido de sus padrastros (16.7 por ciento), tíos (8.3 por ciento), hermanos (5.6 por ciento), primos (2.8 por ciento) y cuñados (2.8 por ciento).

Across the country, groups of male students are making their voices heard! More and more men are finding the courage to say “no” to ideas of manhood and relations between the sexes that aren’t good for women and aren’t good for men as well. They’re speaking out against date rape and violence against women. They support gender equality. Some work through residence life or student activities offices, others through women's centers and counseling programs. Some are campus branches of national organizations like Mentors in Violence Protection, White Ribbon, Men Can Stop Rape, 1 in 4, or V-Men. These men face common problems: How to have an impact? How to find positive ways to get their message to other campus men? How to deal with backlash, to work in partnership with women’s groups, to recruit and sustain their groups? For the first time, campus-based pro-feminist men's groups from across the country are meeting together to share resources, trade their best ideas, discuss strategies, and simply find out what’s happening on other campuses.

México, DF, 9 sep. 09 (CIMAC).- Más de 15 organizaciones civiles de Ciudad Juárez protestaron hoy en el Puente Internacional por la propuesta de Felipe Calderón para que Arturo Chávez Chávez sea el titular de la Procuraduría General de la República, pues señalaron que durante su mandato como Procurador de Chihuahua maltrató a los familiares de las víctimas del feminicidio, denigró a las mujeres asesinadas y obstaculizó las investigaciones por asesinatos y desapariciones, informó Marisela Ortiz Rivera, de la organización civil Nuestras Hijas de regreso a casa.

I found so many interesting posts related to the fight against sexual violence in the blogosphere that I created the Carnival Against Sexual Violence in late May, 2006. Links to past editions are located in the sidebar.

The carnival comes out on the 1st and 15th of each month unless otherwise noted.

As a rape survivor who felt completely alone for many years before finally speaking out about what I went through, I wanted to provide a way for survivors and others who care about this problem to collect our stories and our thoughts. Together we can help those who can't speak about their ordeal to discover they aren't alone and they aren't without hope. We can also raise awareness about attitudes and practices that contribute to the number of assaults that occur every day.

Since this isn't a problem only for women and girls, posts by men are welcome.

The carnival is open to personal stories, creative expression (poetry, art, etc.), legal issues, media watch, raising awareness, solutions and more. You can now add this carnival to your carnival favorites.

I am a survivor of domestic violence from Ireland. I left in 1994 and was shocked at what transpired in secret court. All was fine in the Refuge etc, but once the in camera rule came in, I felt trapped in the silence once more. The gagging order is what did more damage, as not being able to speak truth to anyone was devestating to my soul.

I was in contact with Dr X- Criminology Liverpool, UK and she asked me to write the story for her. I put my story on the net- in the hope of inspiring other women to leave toxic relationships- and also to alert them to the Witch Trials- where in many cases the abuser wins full custody and in UK 55% of women who came forward lost their children to forced adoption.

Every day i get calls from USA, Ireland, UK, Australia etc- all women who have lost their children to the abusers- and these women are deeply traumatised and most suffering PTSD and Legal Abuse Syndrome, because Justice was not Seen, To be done.

I spent 14 years on the run to keep my children and myself safe. We did not even have a toothbrush the night we left.

Our escape was from my abusive husband and the system- social workers who wanted to use ELECTRIC SHOCK TREATMENT on children- to shut them up for telling the truth. My children-were to be sent to a children's prison and kept there- while the abuser of these children walked around free and living with one of my students.

Despacio, la mujer afirma que su hija, de 14 años, desapareció después de que quedar embarazada de un miembro de un grupo armado, quien la presionó para que abortara.

La muchacha, que vivía con su papá, no quería hacerlo y decidió emprender viaje, desde el Meta, en el oriente de Colombia, hacia Bogotá, donde la esperaba su mamá.

Pero la espera lleva seis años, porque la muchacha nunca llegó y no se sabe su suerte.

"Ella venía en un bus para Bogotá, que fue detenido por paramilitares en la carretera. A la única que bajaron fue a ella. La iban buscando", relata la madre, de 48 años, quien omite su nombre y el de su hija por razones de seguridad.

La madre, una mujer desempleada que es madre de otra hija mayor, llora mientras reconstruye los hechos a BBC Mundo, acompañada por la abogada que impulsa el caso en la Fiscalía.

Técnicamente, su hija menor está desaparecida y la madre supone que está muerta, pero no tiene idea de dónde puede estar enterrado su cadáver.

"En el Meta (la zona donde ocurrió la desaparición) hay varias fosas y así es muy difícil encontrarla", añade la mujer sin ocultar su escepticismo.

La desaparición ocurrió el 3 de septiembre de 2003 y hasta el momento la investigación de la fiscalía colombiana no ha logrado establecer quiénes fueron los autores.

"No hay ningún procesado", añade la abogada Carmen Mestizo, de la Casa de la Mujer, una ONG.

La impunidad parecería ser la regla general de las mujeres víctimas de delitos sexuales en medio del conflicto que vive Colombia.

* For 7 years now I have been trying to save my daughter who is now 13. I recently had her for 3 months with an OP against father and she had also been seeing a domestic violence counselor during those 3 months. Father hired attorney, there was a GAL and I was Pro se. The GAL never contacted the counselor because he says he could tell that my daughter is perfectly fine within a 30 minute conversation with her. It was necessary and important for this GAL to talk to the counselor; in fact she should have been the #1 person to call considering she knows better than anyone of my daughter’s state mind emotionally and mentally. In fact her counselor is afraid that she will become a cutter or suicidal and is concerned about her low self esteem. OP was dropped today and she was returned to father. I don’t have money for an attorney, I’ve never been able to find anyone that will do this Pro bono and Legal Aid refuses to help me. On top of this I told the judge that if my daughter was
there in court today she would have told him with whom she wants to live with and the judge said, “well then why didn’t you bring her?” Well, because I thought I had to bring her to school and in my mind and with my luck if I had brought her with today I probably would have gotten into trouble for not having her in school! I never win and I always let my daughter down. Now, I don’t know what to do and no one will help me again. If you are wondering, yes my ex-husband was abusive both mentally and physically and I could write a book on the past 7 years. Yes he hired an attorney for “father’s rights” and yes they said I had a multiple personality-NOT TRUE!!!!! PLEASE I BEG OF YOU CAN ANYONE OUT THERE HELP ME HELP MY DAUGHTER.

In banning sex offenders, Navy faces tough task

YOKOSUKA NAVAL BASE, Japan — Nearly a year after the Department of the Navy issued a tough policy barring sex offenders from Navy and Marine Corps bases, the service is struggling to enforce it.

Sex offenders must be identified and banned from all bases unless they receive a waiver, according to an Oct. 7, 2008, memo from then-Secretary of the Navy Donald Winter and a May 27 memo detailing the order.

But identifying sex offenders could require installations worldwide to check their many thousands of servicemembers, civilians and dependents against flawed and sometimes inaccurate sex offender registries.

United Nations Special Rapporteur on Violence Against Women: 15 Years Later

In 1994, the United Nations Commission on Human Rights appointed a Special Rapporteur on Violence Against Women (SRVAW) after the adoption of a resolution for “integrating the rights of women into the human rights mechanisms of the United Nations and the elimination of violence against women” (United Nations Commission on Human Rights). To date, the position has been occupied by three appointees: Radhika Coomaraswamy (Sri Lanka) from 1994 to July 2003; Dr. Yakin Ertürk (Turkey) from August 2003 to July 2009; and Rashida Manjoo (South Africa) since 2009.

A 15-year report has been published to review the work of the Special Rapporteur since the creation of the post and to position it within a global perspective of the causes and consequences of violence against women. The review specifically analyzes the mandate of the SRVAW; the main areas of violence against women covered by the mandate; methods developed to implement the mandate globally; advances made in the field of women’s human rights; and current and future challenges to women’s rights.

Calif. violence shelters closing amid budget cuts

SACRAMENTO, Calif. — Six domestic violence shelters in California have been forced to close while dozens more are scaling back services after Gov. Arnold Schwarzenegger eliminated all state funding for the program that supports them.

Shelters in the Central Valley town of Madera, the Sierra foothill town of Grass Valley and in Ventura County in Southern California have closed. Others in the San Francisco Bay area, Los Angeles and Bakersfield are on the verge of closing.

Many centers are laying off staff and closing satellite offices that serve remote areas of the state as they cope with the budget cuts. A national domestic violence group describes California's as the deepest cuts to such programs nationwide, even as other states have reduced funding.

In Madera County, officials have turned away six domestic violence victims and eight children since the county's only shelter closed Aug. 7, said Tina Figueroa, the shelter's director. The Martha Diaz Shelter served about 100 victims a year, many of them low-income and with no place else to turn, she said.

"Their only option is the local rescue mission, but they're reluctant to go there because it's a majority of men (who stay there)," Figueroa said. "Also, it's not protected. Anybody could walk in there."

Three families — mothers and their children — who were staying at the secret location also were forced to leave quickly when it was shuttered, she said.

México DF, 7 sep 09 (CIMAC).- Feministas e integrantes de más de 45 organizaciones civiles con trabajo en la defensa de los derechos sexuales y reproductivos clausuraron hoy de manera simbólica la Comisión Nacional de los Derechos Humanos (CNDH) en protesta por el desempeño de su titular, José Luis Soberanes Fernández, a quien reclamaron su “gris” administración, carente de perspectiva de género y a quien acusaron de ser un factor de retroceso en materia de derechos humanos y de las mujeres en el país.

Instaladas afuera de la CNDH y en voz de María Eugenia Romero, de la Alianza Nacional por el Derecho a Decidir, las feministas --quienes se congratularon de la próxima salida de Soberanes Fernández de la CNDH-- lo acusaron de misoginia y de anteponer sus creencias personales por encima de la ley el tiempo que estuvo al frente de esta instancia encargada de velar y defender los derechos humanos de la población.

Lo acusaron de encabezar el “gran retroceso” en materia de derechos sexuales y reproductivos en el país con las reformas aprobadas en 14 entidades federativas que protegen la vida desde el momento de la concepción (sic).

A novel, intensive home-visiting intervention for runaway, sexually exploited girls.

Abstract

PURPOSE: Few studies have examined interventions that help adolescents who run away. This study both describes a home-visiting intervention program for young, sexually assaulted runaways (10-14 years old) and provides preliminary outcomes from the first 20 female participants. DESIGN AND METHODS: Using a strengths-based approach, advanced practice nurses provided frequent home and school visits and case management, and assisted girls to access an empowerment group over a 1-year period. RESULTS: Teens' risk behaviors decreased, including truancy, runaway episodes, sexually transmitted infections, and substance use. CONCLUSIONS: Preliminary results suggest that this is an effective intervention for reducing risk behaviors and helping younger runaways reconnect to school and family. PRACTICE IMPLICATIONS: Client-centered interventions in community settings can address the complex health needs of vulnerable young runaways.

Incluso en los países donde el aborto es permitido por la ley, las mujeres continúan encontrado obstáculos a la atención segura del aborto: obstáculos como falta de conocimiento, costo o distancia. Mejorar el acceso a los servicios de aborto seguro es un imperativo de salud pública.

La Fundación Concepto, en Tailandia, lanzó un nuevo producto, Medabon®, para ofrecer a las mujeres una opción de aborto con medicamentos más accesible y a precios más asequibles. El producto combina los medicamentos utilizados comúnmente en los procedimientos de aborto con medicamentos, mifepristona y misoprostol, en un solo paquete por primera vez. La Organización Mundial de la Salud recomienda este régimen combinado como el método preferido para inducir el aborto. Un solo paquete dará a los prestadores de servicios de salud, farmacéuticos y mujeres la seguridad de que están utilizando los medicamentos adecuados en dosis eficaces.

Campus Violence: Understanding the Extraordinary Through the Ordinary

Abstract:
Recent mass shootings on college campuses have focused many on the responsibilities of colleges and universities to prevent and respond to such violence. However, in statistical terms, this type of campus violence can thankfully be considered relatively extraordinary. In contrast, the only type of campus violence that is unfortunately common enough to be characterized as “ordinary” is peer sexual assault and similar forms of campus gender-based violence. Accordingly, this essay explores the scope and dynamics of both “ordinary” and “extraordinary” campus violence, discusses the law and “best practices” dealing with peer sexual violence victims’ rights and the due process rights of students accused of misconduct, and contrasts the typical disciplinary responses of many schools to both the methods required by the applicable law and those advocated by the best practices literature. It concludes that understanding peer sexual violence and applying that understanding to less common forms of campus violence may help us to prevent and understand what the proper responses should be to both forms of violence.

The president of City College, Gregory H. Williams has asked Elliot Spitzer to teach a course in Law and Public Policy. Meanwhile, Ashley Dupre, a victim of Elliot Spitzer, blogs about how she finds earning a living difficult because she has been unable erase the stain of scandal from her own name. In response, critics of Ms. Dupre post messages like, “You are nothing but a prostitute”.
Elliot Spitzer, you are nothing but a misogynist and shame on City College. The reality is that Ms. Dupre does not have opportunities because she is a woman, not just because she was prostituted. She does not benefit from secret alliances with District Attorneys or College Presidents. If she wants any favors from them, it will have to be in exchange for sex.

Protesting a sick joke from The Onion

Let,s stand up to ingrained sexist, misogynist discourse and actions,
including allegedly cool stuff such as this heinous T-shirt

"Here's some news that I'm sure will get your blood pressure up -- I know mine is. There is a T-shirt available for purchase on The Onion website featuring the slogan, "My Friend Went to Thailand and All I Got Was This
Lousy Prostitute." However, if you look at the image of the T-shirt online, it actually reads, "My Friend Went to Thailand and All I Got Was This Lousy Kidnapped Prostitute."

Either way such a message is utterly appalling. It's hard to believe it, but there are actually people out there who not only dreamed up the T-shirt slogan, but also thought it would be a good idea to
make money on such T-shirts.

Wow, it's not bad enough that millions of women and girls are sexually trafficked, rape, subjected to all kinds of physical and verbal abuse, afflicted by a host of diseases, even murdered, or tossed aside to fend for
themselves when they are no longer "marketable"; now some jerks have to make jokes about it! These people actually have the nerve to mock the abuse and
exploitation of women and children.

Just so you know, I've already called the store and confirmed that the shirt if for real, and that is for sale. Interestingly, I was not allowed to speak to a manager. Evidently the store has already received some complaints, but I think they need a few thousand more. So, won't you please take a few moments and call 1-800-280-1791 to voice your objections? This type of
callousness and outright mockery of exploitation cannot go unanswered.

Please forward this email on to your friends and family. We need as many people calling as possible. Let's make this the last time The Onion ever sells a shirt like this. "
