Sexual Violence Legal News is an on-line subscription service that keeps service providers like hot-lines and shelters aware of the latest changes in relevant law as a result of court decisions. Students involved in this project summarize new cases. The summaries are then sent to subscribers across the country as email alerts. They are also kept on-line in a searchable database. Most of the cases currently in the database involve issues of criminal law and procedure or of evidence.

State and Federal Case Law Now On Google

Google Scholar is indexing the case law in all 50 states - Court of Appeals and Supreme Court - and the federal courts.
As with the other Google search engines, Google Scholar makes use of its own advanced search operators. Search by keywords, personal names, inclusive dates, and specify one or more states in a single search. Options on a single search are limited to 1) Search all legal opinions and journals; 2) Search only US federal court opinions or, 3) Search only court opinions from self-selected states.
Wondering which courts are included and the inclusive dates? Ask Google Scholar Help:

Currently, Google Scholar allows you to search and read opinions for US state appellate and supreme court cases since 1950, US federal district, appellate, tax and bankruptcy courts since 1923 and US Supreme Court cases since 1791 (please check back periodically for updates to coverage information). In addition, it includes citations for cases cited by indexed opinions or journal articles which allows you to find influential cases (usually older or international) which are not yet online or publicly available. Legal opinions in Google Scholar are provided for informational purposes only and should not be relied on as a substitute for legal advice from a licensed lawyer. Google does not warrant that the information is complete or accurate.

Making Misdemeanors Matter

I didn’t plan to spend 25 years in the domestic violence movement. I didn’t even start my career knowing what domestic violence was. I went through Stanford and UCLA and never heard the phrase. I started my career as a prosecutor with every intention of doing some misdemeanors and then working my way up to felonies and then becoming a homicide prosecutor. After all, it is “just a misdemeanor.” It is “only a misdemeanor.” Cops, detectives, prosecutors, probation officers, and judges get treated as important when they handle the big cases not the little ones. If you want to be somebody in the criminal justice system in America, you need to do the “big cases.” If you want to be somebody, you need to handle the big felonies. Anybody who has been around a long time should be doing felonies or there is something wrong with them, right?

Targeted Investments Can Also Radically Reduce Unintended Pregnancies and Unsafe Abortion, and Lower Poverty Levels
3 DECEMBER 2009, LONDON – Maternal deaths in developing countries could be slashed by 70% and newborn deaths cut nearly in half if the world doubled investment in family planning and pregnancy-related care, shows a new report by the Guttmacher Institute and UNFPA, the United Nations Population Fund. Currently, more than half a million maternal deaths and 3.5 million newborn deaths, many of them easily preventable, occur each year, in developing countries.
The new report, Adding It Up: The Costs and Benefits of Investing in Family Planning and Maternal and Newborn Health, also found that investments in family planning boost the overall effectiveness of every dollar spent on the provision of pregnancy-related and newborn health care. Simultaneously investing in both family planning and maternal and newborn services can achieve the same dramatic outcomes for $1.5 billion less than investing in maternal and newborn health services alone.

Child prostitution: Children rescued from sex trade struggle to find care in U.S.

WASHINGTON - -- When the FBI announced a nationwide crackdown on child prostitution last month as part of a long-term initiative to combat domestic sex trafficking, it noted that 52 children had been rescued from "sexual slavery."
"It is repugnant that children in these times could be subjected to the great pain, suffering and indignity of being forced into sexual slavery for someone else's profit," Assistant Attorney General Lanny Breuer said at the time.
But a month later, none of those children is receiving the kind of help that experts say they require to overcome the trauma of their experiences, and some are still languishing in local juvenile detention centers, according to a Tribune Newspapers check of the children's situation.

New York to Become First State to Provide On-Line Victim Notification System in Spanish Statewide
New York will soon become the first state to provide the on-line version of its victim information and notification system in Spanish statewide for any concerned citizen.
With U.S. Census data showing that more than three million New Yorkers speak Spanish as their primary language at home, the New York State Department of Correctional Services (DOCS) is making VINELink, the online version of VINEâ (Victim Information and Notification Everyday), available in Spanish in an effort to eliminate language barriers for Spanish-speaking crime victims and concerned citizens. The Spanish-language service is scheduled to begin December 8, 2009.
New York Statewide VINE is a free, anonymous and confidential phone and Web system that allows crime victims and other concerned citizens to track the custody status of offenders in jail or prison and register to be notified by phone or e-mail when an offender is released, transferred from a local facility to DOCS, or escapes.

Free Legal Research by Google & What It Means

Trackbacks What do I think about Google's recent launch of a free, online legal research tool as part of Google Scholar? (disclosure: my husband works for Google, but isn't involved with the legal research project)
Funny you should ask, because I've been tracking, evaluating and most of all, patiently awaiting the arrival of a functional, robust online research tool for nearly a decade. Back in 2000, I wrote my first piece for the Washington Legal Times, entitled How I Researched A Legal Brief Online for Free (now only available behind fee wall, here) And when I started MyShingle in 2002, I set up a category for "Legal Research & Writing" to track various bar associations' adoption of Casemaker, which at that time was one of few free resources for legal research. In short, I've been around the block long enough to put Google's new tool in perspective -- a welcome step worth celebrating, but far from the game changer that many are predicting. At least yet. Here are my quick thoughts

Criminologist helped get sex slave out of prison

A child trafficking victim was kept in a "house of horrors," only to be imprisoned as an adult for the murder of her batterer.
The case of Maria Suarez, a sex trafficking victim who was unjustly imprisoned by her abuser – then unjustly imprisoned for 22 years in the California Institution for Women for the 1981 death of her abuser – is notable for many reasons.
Hers is a case that has left many asking: How did this happen?
Maria Suarez reacts with joy at a party to celebrate her release from a government detention facility. Though she was paroled from prison in 2004, she was immediately taken into custody by immigration officials. As a legal resident with a felony on her record, the law required that Suarez be deported. In May, 2004 she was granted a temporary visa for victims of human trafficking and was released from detention.
Suarez's horrifying experience — imprisoned from the age of 16 for five years in the home of a 67-year-old Azusa man who repeatedly raped her — reveals how she slipped through several cracks. It also shows how, subsequently, she was betrayed by a justice system that instead of aiding her put her behind bars for life.
But her case also reveals a ray of hope. That's because someone – Elizabeth Dermody Leonard – was paying attention. And she helped kick off the process that would eventually free Suarez, now 49.
