México, DF, 9 abr 10 (CIMAC).- La actual crisis política nos da a las mujeres la oportunidad de encabezar la agenda del futuro. “Ya les dimos oportunidad a los hombres, durante muchos años… es tiempo de que las mujeres ya no nos conformemos, es hora de plantear propuestas de Estado que identifiquen a toda la ciudadanía” afirmó Ruth Zavaleta Salgado.

En entrevista con Cimacnoticias, quien militó hasta noviembre pasado en el Partido de la Revolución Democrática (PRD), dijo que esta es la oportunidad de las mujeres, “ya les dimos chance a los hombres”.

A diferencia de los hombres (quienes tienen la confianza), “las mujeres nos tenemos que ganar esa confianza y ya lo hemos demostrado en espacios del ejercicio del poder, donde no sólo estamos peleando agendas de género, nuestras banderas tienen que ver principalmente con la justicia, estamos peleando contra la pobreza y la desigualdad”, dijo.

Invasion of Privacy: Court of Appeals of Texas Finds Trial Court Properly Excluded Evidence of Alleged Victim’s Prior Nonconsensual Sexual Acts Under Rape Shield Rule
Texas Rule of Evidence 412(a) provides that

In a prosecution for sexual assault or aggravated sexual assault, or attempt to commit sexual assault or aggravated sexual assault, reputation or opinion evidence of the past sexual behavior of an alleged victim of such crime is not admissible.

Meanwhile, Texas Rule of Evidence 412(b) provides that

In a prosecution for sexual assault or aggravated sexual assault, or attempt to commit sexual assault or aggravated sexual assault, evidence of specific instances of an alleged victim’s past sexual behavior is also not admissible, unless [an exception applies].

The most typical rationale for such rape shield rules is that they prevent evidence of an alleged victim’s prior sexual acts to be admissible to prove that the alleged victim has a propensity to consent to sexual acts and thus likely consented to the sexual act at issue. If this were the only rationale, evidence of an alleged victim’s prior nonconsensual sexual acts would not be precluded under such rules. While not explaining its reasoning, the Court of Appeals of Texas, Forth Worth, did not reach this conclusion in its recent opinion in Bryan v. State, 2010 WL 1137038 (Tex.App.-Fort Worth 2010). This post explains why I agree with the court’s conclusion.

When I was in Saudi Arabia, I had tea and sweets with a group of educated and sophisticated young professional women.

I asked why they were not more upset about living in a country where women’s rights were strangled, an inbred and autocratic state more like an archaic men’s club than a modern nation. They told me, somewhat defensively, that the kingdom was moving at its own pace, glacial as that seemed to outsiders.

How could such spirited women, smart and successful on every other level, acquiesce in their own subordination?

I was puzzling over that one when it hit me: As a Catholic woman, I was doing the same thing.

A NATIONAL SURVEY OF TEEN DATING VIOLENCE LAWS
Some States Improve Laws, Many Slow to Change

Break the Cycle released the 2010 State Law Report Cards: A National Survey
of Teen Dating Violence Laws, which grade how well states protect minors
from abusive relationships.

"Lawmakers must pass legislation to safeguard all victims of abuse -
regardless of their age or sexual orientation," said Marjorie Gilberg,
Executive Director of Break the Cycle. "We are so pleased to see state
leaders taking action to help protect young victims but there is still a
long way to go if we are serious about ending teen dating violence."

Sample of Key Findings
. New Hampshire receives the highest score as the only state
allowing minors of any age to petition for protection orders without
parental involvement.
. Arizona (B) and the District of Columbia (A) improved their laws
since last year. Arizona now grants protection orders to those in dating
relationships. In DC, teens as young as 12 can now petition for protection
orders without parental notification.
. Ohio receives an F, but Governor Ted Strickland recently signed
into law a bill mandating violence prevention education in schools and
clarifying their restraining order statutes, allowing minors and people in
dating relationships to legally protect themselves. Changes take effect
later this year and will be reflected in the 2011 Report.
. Pennsylvania (D) is considering a bill mandating violence
prevention education in schools. Though not a factor in the 2010 grades,
this could work in their favor for the 2011 report.
. Kentucky (F) has pending legislation that would allow victims of
abuse in dating relationships to access protection orders. If it passes,
Kentucky's grade could rise to a B, based on our current metrics.

Una niña yemení de 13 años murió por una hemorragia originada por un desgarro en sus órganos genitales, tres días después de su boda, en el oeste del Yemen, denunció hoy en un comunicado una ONG del país árabe.

La menor Ilham Mahdi Al Asimurió el pasado 2 de abril en la provincia de Hayyat, a unos 120 kilómetros al noroeste de la capital yemení, precisó el Foro Árabe Al Chaqaeq para los Derechos Humanos, que es una organización que defiende a la mujer.

La niña se casó por una costumbre local conocida como "Al Badal", que obliga a la mujer a contraer matrimonio con un hombre, a cambio de que la hermana de este se case con el hermano de ella, indica la nota.

La ONG instó a "convertir a Ilham en un símbolo que confirma la brutalidad del crimen y los riesgos que sufren las menores debido a este tipo de casamientos prematuros".

Este suceso se produce en medio de una gran polémica en el Yemen a raíz de una decisión del Parlamento de fijar en 17 años la edad mínima para que una mujer pueda casarse, a lo que se oponen grupos islamistas y clérigos porque, dicen, "prohíbe lo que permite Aláh".

La controversia enfrenta a esos grupos islamistas con activistas pro-derechos de la mujer, que prefieren que las adolescentes yemeníes agoten su infancia y se preparen mejor para formar una familia.

El debate estalló después de que el Parlamento aprobara en febrero pasado la introducción de una enmienda a la ley de Asuntos Civiles, que fijó en 17 años la edad mínima para que las chicas puedan contraer matrimonio.

Sin embargo, los diputados pertenecientes a partidos islamistas han pedido volver a debatir en el Parlamento la normativa, que aún no ha sido promulgada por el Gobierno.

13-year-old Yemen Bride Dies of Bleeding

SAN'A, Yemen — A 13-year-old Yemeni girl has died of injuries to her genitals four days after a family-arranged marriage, a human rights group said.

The practice of marrying young girls is widespread in Yemen and has drawn the attention of international rights groups seeking to pressure the government to outlaw child marriages. Legislation that would make it illegal for those under the age of 17 to marry is in serious peril after strong opposition from some of Yemen's most influential Islamic leaders.

The 13-year-old girl from Hajja province, northwest of the capital, died on April 2, four days after her marriage to a 23-year-old man, said Majed al-Madhaji, a spokesman for the Sisters Arab Forum for Human Rights. A medical report from al-Thawra hospital said she suffered a tear to her genitals and severe bleeding.

Authorities detained the husband.

The Yemeni rights group said the girl was married off in an agreement between two men to marry each other's sisters to avoid having to pay expensive bride-prices. The group said that was a common arrangement in the deeply impoverished country.

Yemen's gripping poverty plays a role in hindering efforts to stamp out the practice, as poor families find themselves unable to say no to bride-prices in the hundreds of dollars for their daughters.

More than a quarter of Yemen's females marry before age 15, according to a report last year by the Social Affairs Ministry. Tribal custom also plays a role, including the belief that a young bride can be shaped into an obedient wife, bear more children and be kept away from temptation.

Last month, a group of the country's highest Islamic authorities declared those supporting a ban on child marriages to be apostates.

A February 2009 law set the minimum age for marriage at 17, but it was repealed and sent back to parliament's constitutional committee for review after some lawmakers called it un-Islamic. The committee is expected to make a final decision on the legislation this month

Arab woman to head UN’s new gender programme?

Cairo - In the halls of the United Nation's New York bureau, officials have been considering a proposal to unify the UN’s many organisations promoting women’s equality and rights into a single “gender entity”. This entity would have a greatly increased budget – exactly how much is still being debated – and would be headed by an executive at the rank of Under-Secretary General.

This is a tremendous opportunity for the United Nations to step up funding for global women’s issues and to create something greater than the sum of its parts. Current women’s activities are run by the Division for the Advancement of Women (DAW), the Office of the Special Adviser to the Secretary-General on Gender Issues and Advancement of Women (OSAGI), the UN Development Fund for Women (UNIFEM) and the UN International Research and Training Institute for the Advancement of Women (INSTRAW). It’s also a once-in-a-generation chance for the UN to turbo-charge women’s rights in the Middle East by appointing someone from the Arab region to lead the new gender entity.

U.S. Naval Academy position

Colleagues,

The Naval Academy is advertising a new position in our Sexual Assault
Prevention & Response Office beginning Wednesday, April 7 and closing
Tuesday, April 13. This new full-time GS-9 SAVI Liaison position was
previously held by a Navy lieutenant. In transforming it into a civilian
position, we expect to be able to hire someone for the long haul who has the
experience, training and passion for helping sexual assault victims.

The SAVI Liaison will be the point of contact for midshipmen (student),
faculty and staff sexual assault victims at the Naval Academy. In addition
to some direct victim care, one of the SAVI Liaison's primary duties will be
to supervise and manage volunteer victim advocates and midshipmen peer
contacts. The position will also be responsible for establishing and
maintaining collaborative working relationships with other key staff members
at USNA to further our response efforts. Outreach and training will also be
important among the duties.

We are in a very exciting phase of our Sexual Assault Prevention & Response
programming. The SAVI Liaison will not only have a hand in shaping his or
her own position but in helping us take our response programming to new
levels.

PARTNERS’ CONTROL OF WOMEN’S REPRODUCTIVE OPTIONS MAY LEAD TO ABORTIONS AND UNWANTED BIRTHS

Male reproductive control—which takes place when a woman’s partner imposes his reproductive intentions on her through intimidation, threats or actual violence—occurs among women who have experienced intimate partner violence, according to “Male Reproductive Control of Women Who Have Experienced Intimate Partner Violence in the United States www.guttmacher.org/pubs/journals/socscimed201002009.pdf ,” by Ann Moore http://www.guttmacher.org/media/experts/ moore.html et al. The article is currently available online and will be published in a forthcoming issue of Social Science & Medicine.

The authors conducted in-depth interviews with 71 women aged 18–49 who had a history of intimate partner violence; they were recruited in 2007 from a domestic violence shelter, a freestanding abortion clinic and a family planning clinic providing a full range of reproductive health services. The study found that 53 respondents (74%) reported having experienced some type of reproductive control. Women reported that their partners threatened them before sexual intercourse and insisted that they were going to make them pregnant. They were also prevented from obtaining or using contraception. During sexual intercourse, women experienced a range of behaviors by partners actively seeking to cause a pregnancy. Women reported forced or unwanted intercourse (sometimes unwanted only because it was unprotected), failure to withdraw when that was the agreed upon method of contraception, refusal to use condoms or manipulation of condoms to render them ineffective, and violent rape.

Women who became pregnant reported experiencing pressure or coercion to resolve the pregnancy in the way their partners wanted. Some women who wanted to terminate the pregnancy reported that abusive partners made them feel bad about their desire to abort and pressured them to give birth. Others reported that their partners refused to allow them to have an abortion, denying access by withholding money for transportation or the abortion, sabotaging appointments, and coming to the clinic and “breaking things up.” Some also described partners who threatened to harm or kill them if they had an abortion. Among women who wanted to continue the pregnancy, some described experiencing pressure or coercion to terminate the pregnancy, while others reported that their partners threatened to hurt them in order to bring an end to the pregnancy. The authors point out that threats and coercion by men to achieve their own pregnancy desires that are contrary to their partners’ wishes often leave women unable to act autonomously.

“We believe that reproductive control is, itself, a form of intimate partner violence, and one worthy of public health attention,” says Ann Moore http://www.guttmacher.org/media/experts/moore.html, senior research associate at the Guttmacher Institute. The authors recommend that providers assess their patients in order to identify women who may need to hide their contraceptives from their partner, conduct prenatal care and abortion counseling in private, and ask questions designed to ascertain if anyone is pressuring the woman either to terminate or continue the pregnancy.

Amnesty International has urged the Ugandan authorities to provide support for women seeking justice for sexual and domestic violence in a new report highlighting the barriers faced by the victims.

I Can’t Afford Justice – Violence against women in Uganda documents the economic and social obstacles to justice, including the costs of criminal investigations and discrimination by government officials.

Victims are left facing inadequate responses by police, having to pay for the cost of police transportation to arrest the accused, forensic examination fees and other expenses related to the investigation.

Some official responses to sexual violence also reflect a widely held attitude that the women are to blame for sexual violence in a country where the government often appears to promote “preservation of the family unit” ahead of justice for victims.

“The failure of the government to protect and support victims of sexual violence undermines the quest for justice,” said Widney Brown, a senior director of Amnesty International. “Lack of government resources and political will mean that perpetrators rarely face justice. Women in Uganda have been left with no faith in the justice system.”

Violence against women and girls in Uganda remains widespread. Two thirds of women who have experienced domestic violence say it was perpetrated by an intimate partner, while one in four women report that their first sexual experience was forced.
